Q: How do I file a Motion to Dissolve the Writ of Garnishment
I am being sued by a hospital. Since 2016, I have not been served with any court documents. The lawyer pursuing this case has had my address and place of employment incorrectly listed until just a few months ago. Now, they are attempting to garnish my wages. I filed a Claim of Exemption on September 3, 2024, after they finally served the correct information to my legitimate place of employment. On October 11, 2024, a WRIT OF GARNISHMENT RETURNED SERVED 8/26/2024 was posted to the docket. Then, on October 31, 2024, I received a notice under Florida Statute § 77.055. Which I now believe I have to file a Motion to Dissolve the Writ of Garnishment.
