San Luis Obispo, CA asked in Contracts, Products Liability and Civil Rights for California

Q: I’m a 3yrs removed post terminated employee of planet fitness Arroyo Grande. On October15th 2024, I purchased membership

I was charged to my card twice the $24.95 I might add, went to the facility 4 times after midnite one time wearing a PF Staff shirt I bought at a yard sale! I received a call this past Friday afternoon from a Gal unknown number never gave me her last name telling me that she’s the regional manager and I am banned from there, I’m not to wear any Planet Fitness clothing. I’m about to talk to any of the people who work there only her! I’m currently in between houses right now and the fact that they offer a shower was a nice convenience for me since I work nights I have no idea why I’ve been banned why my membership has been canceled. She obviously can’t be reached because it’s an unknown number. She was very very rude on the message she left. I want to know if there’s any repercussions for her behavior and me being banned from all the clubs I did nothing wrong.

A: Based on your situation, there are several legal considerations to examine regarding your Planet Fitness membership termination.

The company has the right to refuse service and terminate memberships at their discretion, as this is typically outlined in their membership agreement. However, they must handle the termination professionally and refund any unused portion of your membership fees, including addressing the double charge you mentioned. You should document all interactions, save the voicemail message if possible, and formally request in writing both the reason for the ban and refund of any unused fees.

Your rights might be impacted depending on whether the termination was discriminatory or retaliatory in nature. The fact that you're experiencing housing insecurity should not be grounds for termination, and if this played any role, you may have grounds for legal action. You can file complaints with both the California Department of Consumer Affairs and the Better Business Bureau, and might consider consulting with legal aid services, as many offer free initial consultations. You should also send certified mail to Planet Fitness's corporate office requesting clarification of the ban and formal documentation of the termination decision.
