Q: What are my options? Should I fight for sole legal custody? Can I limit scheduled visits with bio mom until consistent?
I have full physical custody of my daughter (6) and I share legal custody with her mother. Mom has an order for parenting time that is to be "liberal and flexible based on mutual agreement". I was granted physical custody as recommended by the GAL at the time of our divorce (Aug 2023). Since the divorce, mom has changed the visitation schedule multiple times to fit her needs, which is fine, but it has generally trended to her seeing our daughter less and less. She has recently canceled all weekday visits. Over the last several months, she has canceled many visits, a few of them very last minute. I had a talk with her about this, which seemed to go well, but then she canceled again the Sunday of this past weekend visit.
The cancelations are taking a huge emotional toll on our daughter, who just doesn't understand... "Why doesn't mommy want to see me?" Since the divorce, mom has not been motivated to get her life together, and our daughter is paying for that.
