A: Marital assets and debts are considered in the equitable division of a marital estate. In New Jersey, the statute governing the equitable division of marital property in divorce cases is found in N.J.S.A. 2A:34-23. This statute outlines the guidelines for the division of assets and liabilities in a divorce, stating that marital property should be distributed fairly based on factors such as the length of the marriage, the financial and non-financial contributions of each spouse, and other relevant circumstances. Relevant considerations in evaluating distribution include whether pre marital funds or inheritances were used to acquire assets and whether debts were incurred jointly and/ or for the benefit of the marriage, among others. It is recommended that you contact a family law attorney to specifically address the issues you raise because other factors such the appropriateness of spousal support may be adjust the division.
