Q: Insurance company with liability and their obligations to provide a rental?
This is a two-part question.
If an out-of-state driver is found at fault for an accident and their insurance company has accepted liability, is it their state law that governs the claim? Or is it South Carolina law, where are the accident occurred and the victim lives, that covers the claim?
Does South Carolina law require the at-fault insurance company with liability to provide a rental car to the victim that's comparable in size and function to the vehicle totaled? I was told South Carolina law does not require that, unless it's a family of seven or more. So since I'm a family of just four, instead of a vehicle comparable to my 2024 Hyundai palisade xrt, just totaled, i was given a compact car, such as a Nissan Sentra without an option unless I wanted to pay for it myself. Is that really how it is?
