Q: Paternity and child custody
My son has a two year old daughter and is not married and does not live with child’s mother. They both recently found out that even though he signed paperwork at birth of his daughter, the hospital did not include his name as the father therefore he is not on the birth certificate. She moved to Kansas and took the child without an agreement between the two. The last time he saw his daughter was around September 4th 2024. The child’s mom does not want to let him see her and will not provide her address. We are needing some guidance please.

A: Depending on when she moved to Kansas, he may need legal counsel either in Oklahoma or in Kansas. The "home state" of a minor child is generally defined as the most recent consecutive-six-month period where the minor child has resided. Whether the case ends up in Oklahoma or Kansas, he may be required to submit to genetic testing to prove that he is the father. He will need to develop a strategy with a lawyer for his parental rights, including rights of custody and visitation.
