Mesa, AZ asked in Contracts for Arizona

Q: Is the clause saying that if the firm withdraws, I do not owe them anything unless a settlement is reached afterward?

"The Firm may waive its right to additional fees and withdraw as your legal counsel

at any time upon giving reasonable notice. In the event you desire to terminate our

representation or accept an offer of judgment tendered by the Defendants, you agree to pay

our hourly fees incurred to the point of termination attributable to your individual share or

portion of the claims asserted, plus a pro-rata share of any costs and expenses incurred to

that point in time. In the event this agreement is terminated by the voluntary withdrawal of

the Firm before settlement or ultimate recovery, the Firm is entitled to be paid the fees and

expenses incurred to that point from any subsequent recovery, settlement, judgment, or

fund established by the lawsuit. No additional fees or expenses beyond the hourly fees and

expenses incurred to the date of termination of the representation shall be payable to the

Firm."
