Q: When a person passes away from Asbestos, is there any way to find out whom they made there beneficiary?
A: HI - while your question is a bit vague, I will answer the best I can. If someone dies from asbestos (mesothelioma/lung cancer/asbestos), those who have a statutory right to file a Wrongful Death claim/case are heirs (typically surviving spouse and/or children). Someone who dies from Asbestos Disease cannot prevent a Statutory Heir from filing a Wrongful Death case. If you are a direct heir of someone who died from asbestos, please call my office. With regards to "Beneficiary" status of Decedent? That relates to Estate/Probate documents. If the person who died from Asbestos left a will/Trust - that will determine who the Beneficiary (and the Trustee) is. If you are an immediate heir OR Beneficiary OR Specifically mentioned in the Trust/Will/Estate Documents - you will get "Notice". If I didn't answer question, please do call me.
A: When someone dies from an asbestos related disease, who they made the beneficiary of his or her estate will be in the Will if the person had one. But that does not exclusively determine who has a right to sue for the death. The law of the state where the death occurred establishes the right of who can sue. That is usually the spouse, parent, and children of the deceased in addition to the beneficiary of the estate. But some states also provide for siblings to sue as well. You just have to consult a lawyer with experience handling asbestos disease cases. We have been representing people with asbestos diseases for over 30 years but there are many experienced lawyers in this field. Just be sure to consult one who knows what they are talking about.
