Atlanta, GA asked in Business Law, Civil Litigation, Consumer Law and Contracts for Georgia

Q: Under Georgia law what is the duty of care that a professional landscaping company is responsible to their client?

Contracted with local professional landscaping company to perform hardscaping (patio) and landscaping (sod, shrubs, trees) design and install on our home property. While most work was completed satisfactorily, a problem with poor drainage in the backyard caused about half of the newly installed sod to yellow and eventually die over a 6-8 month period of time. The design included 2 dry creek beds to assist water runoff and one drain box near the patio "to capture the natural water runoff in the low area" but the landscaper decided to not add the drain box at some point during the install and that area is where the water drainage is poorest. Had a water drainage professional recently onsite and they recommended adding 4 drain boxes to solve the problem. Do I have any grounds for compensation or redress for the added drain boxes or the new sod that will need to be installed next spring? く
