Q: What are my rights as a disabled individual who had safety concerns willfully ignored by my landlord for months?

I provided previous documentation via emails, physician verification of my disabilities, numerous phone calls to the leasing office records, documentation of my maintenance requests falsely solved in the resident portal as well as these willful violations of my right to ensure a safe and peaceful environment. These violations ended up causing severe emotional distress due to the neglect of landlord to fulfill their consistent obligations for negotiating reasonable accommodations to mediate issues of non-compliance. I gave notice to the property and relevant parties the day before I moved into my assigned unit. For about 3 to 4 months (Late August to Early December) I consistently endured housing violations that exacerbated my disabilities and ability to pay the full balance on time. There were/are consistent prohibited charges on my account due to negligence of landlord to remain in constant compliance of Fla Statutes, ADA and Fair Housing laws for disabled individuals.

A: You may be able to terminate the lease. However, it appears you likely need to provide a notice to cure under the statute and thereafter you may be able to exercise your right to termination of the lease and/or rent abatement.
