Q: Subrogation Claim After 1.5 Years – Rental Company Negligence

Rental Period: April 19–April 25, 2023.

Incident: Minor incident involving a rental car (no third party).

Insurance Provider: AMEX; claim was promptly filed with all required details.

Rental Company Actions:

- Contacted me on May 17, 2023, requesting payment.

- I requested the correct rental agreement on the same day since the agreement they had didn’t match the vehicle involved.

- They never responded or provided the correct documentation.

No Follow-Up: For 1.5 years, the rental company did not communicate further.

Current Situation: January 2025, I received a letter from a subrogation agency claiming I am liable for the loss and threatening legal action.

I have all evidence in email even sharing my AMEX Claim number over email.

Questions:

Should I respond to the agency, and if so, how can I ensure I don’t admit liability?

If AMEX denied the claim due to missing proof of loss (caused by the rental company’s negligence), am I still liable?
