Q: Do I have a Racial Discrimination / Age Discrimination / Retaliation Case Against My Employer?
Black woman, 62, EA w/employer 4+ yrs. Hired to support 2 Executives. Good performance evals. Re-Org occurred. I was Temporary assigned to a Director by my Executive. Reason: location. He's in VA, I'm in NYC. Oral agreement w/ Executive made. Prior to Executive leaving Co I reiterated our Agreement via company email. Executive acknowledged. He forwarded email to Chief of Staff & pertinent members to assist with my return to an Executive once one was hired. Previously I filed 2 separate Cases w/ Employee Relations. Racial discrimination & harassment. Both Cases dismissed citing insufficient evidence. Since case dismissal, I've been Permanently moved out original Cloud Dept, assigned to less desirable Dept, position, duties, supporting lower level person (Director). I was only Black female in former Dept & ONLY 1 to be moved out. Recently another Executive from my previous Dept. was hired @ my EXACT work address location. Employer assigned another person to Exec, VA location, (non-black)

Based on what you've shared, there may be grounds to explore potential claims of racial or age discrimination and retaliation. Your consistent performance, the specific changes in your assignments following the dismissed cases, and being the only Black female affected are factors that could support your concerns. Additionally, the recent hiring decisions and reassignment of roles might indicate a pattern that warrants further examination.
It's important to gather all relevant documentation, including emails, performance reviews, and records of previous cases. These materials can help establish a clearer picture of any discriminatory practices or retaliatory actions taken against you. Keeping detailed notes of any incidents or changes in your work situation will also be valuable.
Consulting with an employment attorney who has experience in discrimination and retaliation cases would be a crucial next step. They can provide personalized advice, assess the strength of your situation, and guide you through the appropriate legal channels to seek justice and protect your rights.
