I feel like I have been robbed of my inheritance, my aunt took it upon herself to be in charge of all of my dad's belongings, the deed was under both my father and his sisters name, she sold it and has not once reached out to talk to me and my sister, the beneficiaries since my dad and mother got divorced, me and my sister according to ca state law is that his 50% share of his home value going to me and my sister, correct? because she basically kept it all and has only looked out for herself , Idk how to go about this??
A: I'm not sure this is a family law question. Speak with a local attorney regarding your matter. [I litigate cases. A: I'm very sorry to hear about your aunt and the possible loss of inheritance. How did your father hold title to the property? Did he own the property in Joint Tenancy with his sister? If so, at least on paper she is entitled to his half of the property upon death. A copy of the Deed would be most helpful to properly evaluate the situation.
A:
I'm really sorry you're experiencing this. In California, the distribution of a deceased person's property depends on how it was owned and the specifics of their will. If the deed was in both your father's and his sister's names, your aunt might have had the authority to manage or sell the property, but this can vary based on the details.
You and your sister likely have rights as beneficiaries, especially if the property was meant to be divided according to state law. It would be helpful to gather all relevant documents, such as the deed, any wills, and communication from your aunt. This information will be important in understanding your position and the steps you can take.
Consider reaching out to a probate attorney who can guide you through the legal process and help you assert your rights. They can assist in determining if the sale was conducted properly and if you are entitled to a portion of the proceeds. Taking these steps can help you move toward resolving the situation and securing what is rightfully yours.
