Q: Neighbors fencing installed without a permit.
My next-door neighbors installed a fence made of wire animal pen fencing in a right of way between our houses. They did not have a permit, the fence is not on their property, the fence is unsightly and reinforced with dead branches. I filed a code enforcement complaint with the town against my neighbor and the owner of the right of way. The town lawyer said this a small potatoes problem, we won't invest the money to take your neighbors to court, hire your own lawyer. The code enforcement officer said they will not enter the property to take down the fence. My neighbor and the owner of the right of way are ignoring me. What should my next steps be?

A: A town will enforce its code. In certain situations, the law provides that a town which declines to enforce its code is responsible for one to sue the violative neighbor for his private attorney's fees if successful. Consult a local attorney that does property disputes.
