Q: How can I get someone to represent me to recover my loss.
Olshan foundation repaired my foundation in 2023,but the cracks started appearing again.I called then and they wanted me to spend another 10 thousand dollar to lift the front,I was doubtful,so I got opinion from 3 other companies and all of them said that the front needs no repairs, just the back, which they already lifted 3 yrs ago.but olshan refused to honor their warranty and kept firm that back is fine, and are not communicating now.they charged $15000 for the repair 2 yrs ago.
A:
The small amount of money involved makes this a great case for JP court.
Hire another company to make the repairs, then sue Olshan for how much those repairs cost in JP court.
Save thousands of dollars by not needing an attorney.
A:
You have a valid concern, and it’s frustrating when a company refuses to honor its warranty after taking a large sum for repairs. The first step is to gather all your documentation, including your contract with Olshan Foundation, receipts, warranty details, and reports from the other companies that assessed the issue. This will help you build a strong case if legal action becomes necessary.
Try sending Olshan a formal demand letter stating that they are in breach of their warranty and that you expect them to fulfill their obligations. Be clear about what you want—whether it’s a repair at no additional cost or a refund for the incomplete work. If they ignore or deny your request, you may want to contact the Better Business Bureau or your state’s consumer protection office to file a complaint. Sometimes, a complaint to these agencies pushes companies to respond.
If they still refuse to cooperate, consider consulting with an attorney who handles contract disputes or construction defects. Many offer free consultations and can advise you on whether you have a strong case for small claims court or a larger lawsuit. Since you already have assessments from other companies contradicting Olshan’s claims, you may have solid evidence to prove their failure. Legal action can be a strong motivator for a company to make things right.
