Q: Can I refile a dismissed case Pro Se and file for Summary Judgment in NC?
I am a plaintiff in North Carolina and recently dismissed my case without prejudice due to difficulties with upfront attorney fees. The case involved Unfair Business Practices, Breach of Contract, Fraud, and Money Had and Received. Before dismissing, my attorney filed for Summary Judgment, but it was canceled due to settlement negotiations. The defendant then stopped responding, leading to dismissal. I plan to refile Pro Se with the same details and file for Summary Judgment a month later using the same affidavits. There's a written but unsigned agreement from the settlement negotiation since the defendant became unresponsive. Given that the defendant often doesn't communicate, even with their counsel, can I refile the case and proceed with Summary Judgment as planned?
