Lawrenceburg, KY asked in Family Law and Public Benefits for Kentucky

Q: How do I start the legal guardianship process for my daughter in Kentucky?

I am seeking guidance on obtaining legal guardianship of my 18-year-old daughter, who is transitioning from SSI for her paranoid schizophrenia, OCD, and generalized anxiety. The Social Security office is conducting a medical review under adult rules, and I was informed that I need legal guardianship to ensure she can continue living with me. I am uncertain where to begin the guardianship process. Should I start at the courthouse or the county attorney's office? Additionally, I am concerned about proving the necessity of my guardianship. Any help on how to initiate this process would be appreciated.

A: Go to the district court clerk’s office in your county and tell them you want to file a petition for disability/guardianship of your daughter. They have all the necessary forms and will assist you in filing the petition.
