Q: Can I sue for a failing transmission after purchase if seller promised repair?

I purchased a truck for $5,000 three weeks ago, and the seller knew the transmission was failing. Before buying, he advised me to have it inspected, claiming he would fix any issues. Upon inspection, I found out that repairing the transmission will cost $6,300, as there are metal pieces in the transmission fluid and it knocks hard. Additionally, we discovered a scanner in the truck after purchase. There was a verbal agreement with three witnesses present that he would fix the truck. We haven't communicated with the seller since the inspection. Can I sue the seller under these circumstances?

A: I would first write to the seller asking him to repair the truck via the verbal agreement. If he fails to repair it, you can sue and with three witnesses, might give you a pretty good case.
