Union, KY asked in Employment Law and Employment Discrimination for Kentucky

Q: Held out of service unpaid pending unwarranted insubordination investigation. How long can this last?

I have been held out of service unpaid, pending an investigation for an unwarranted insubordination claim that resulted in my removal from my warehouse job. During this time, I have filed an ethics violation against the involved manager. I have eye-witness statements that verify the manager's wrongdoing and unprofessional behavior, including profanity. Additionally, the general manager has threatened one of the witnesses by calling them a liar and later giving them a documented corrective action. I am not supposed to know about these threats yet, so I haven't informed the investigators. There are other similar cases against the company involving other individuals. How much longer can they legally hold me out of service unpaid while this investigation is ongoing?

A: Unfortunately, the investigation can last a while before it concludes. You might want to consult a lawyer if the investigation is not concluded soon.
