Q: Am I protected from being sued for my artwork at a museum?

I own an interactive artwork that is being exhibited at a museum. The museum has liability insurance, but I am not listed as an additional insured under their policy. There is also no specific clause in our agreement related to liability protection for me. Am I protected from being sued if something happens with the artwork?

A: A Texas attorney could advise best, but your question remains open for a week. I'm not clear on what you mean by "interactive" artwork. Does your artwork have the possibility of physically injuring guests? You could consider asking the museum how their insurance normally covers injuries to guests from foreseeable events - artworks dropping from wall mounts, falling over, or similar incidents. You could ask other artists what their ordinary practices are. There's no point paying for additional insurance if the museum's coverage addresses ORDINARY things that could take place. But that "interactive" aspect of your works - it could possibly require further review, based on what you mean. An insurance professional might be able to make recommendations there if supplemental coverage is needed, given more detail about the artwork. Good luck
