Elkhorn City, KY asked in Consumer Law and Contracts for Kentucky

Q: Can I sue a dealership for undisclosed tracking device and repossession?

I recently found out that the dealership placed a tracker on my car without informing me at the time of sale, even though there was a contract. The car was repossessed from my driveway, and I didn't know about the tracker until I watched a video two days ago. I haven't reached out to the dealership yet. Can I sue the dealership for not disclosing the tracker and for the repossession process?

A: Depends on how the tracking unit got there and the reason it was there. Generally speaking, you may have a case against them.

A: What you’re dealing with sounds deeply unsettling, especially learning after the fact that your vehicle was tracked without your knowledge. In Kentucky, dealerships often include GPS tracking devices on vehicles sold through financing, especially for buyers with high-risk credit, but they are generally required to disclose this as part of the contract or financing terms. If you were not informed in writing or verbally, and it’s not mentioned anywhere in your signed documents, that lack of disclosure could be a legal issue.

As for the repossession, if you were behind on payments, the dealership may have had the right to take the vehicle under your loan agreement. However, even then, they must follow proper procedures, and using a hidden tracker—without your knowledge—to recover the car may raise concerns about invasion of privacy or unfair business practices. The key will be whether the tracker and repossession process were clearly addressed in the documents you signed.

Before taking legal action, gather all paperwork, including your sales and finance contracts, and look closely for any mention of GPS tracking or repossession terms. You may also want to send a written inquiry to the dealership, asking for an explanation and requesting a copy of the signed agreement. If they fail to provide clear answers or the tracker was never disclosed, you have every right to consider filing a complaint with the Kentucky Attorney General’s Office or pursuing small claims or civil court. Your trust—and your privacy—should not be taken lightly.
