This question is more complicated than a simple answer can provide. There are too many variables. We're you married? Is father on the birth certificate? Has there ever been a court order concerning your daughter? What do you mean by full custody? Find a local attorney and go get a consultation.

Q: I have sole custody of my child. His father is in another state and had never paid any of his child support.

Yes. Father will automatically receive custody. If you do not feel this is in the child's best interest, do a will and name the person you would like to have custody upon your death. That person can then use the will to file for guardianship of your child.

Yes. Income is only one consideration in determine child support. The other is timeshare. What is mother's timeshare? This information is needed to calculate child support.

Q: My divorce was granted but before the effective date of the divorce we decided to work on our marriage. The judge

dissmised our divorce so it was stoped before it became legal. I now want re-open the case. Do I have to start all over with the filing? Or can my case just be re-opened and just go from there?

If your case was dismissed, the lawsuit no longer exists and you must start over with the whole process. The waiting time will start over, too. If the court put the case on hold, you can pick up where you left off. Go to the courthouse and ask if the case has been dismissed.

You can go to the California judicial counsel website to download the most current forms. Many of them have not changed in years. Don't be surprised if 2008 is the most recent revision of the forms you are asking about.
