A judge will not deem a case to be "frivolous" unilaterally. The opposition should file a motion for summary judgment if the case has no merit whatsoever.
now I required to pay lawyer fees. order for default re ORCP69 based on this claim my "friend" had told me to enter a counter claim for $50,000 so I did. separate. how will that effect the trial de novo. and can I cancel before it harms me the counter claim today?

motel at gold beach, Orgeon. a death resulted inside of room (carbon monoxide poisoning)at motel. I live in Calif.
