Q: If my employer did not pay me at the time I was laid off, what can I do?

A: Under Maryland law an employer is required to pay any earned pay upon termination. This means on payday an employer can't withhold already earned wages just because an employee was let go. If the regularly scheduled pay period has passed and the employer refuses to tender earned wages, the aggrieved employee can press suit for unpaid wages. It isn't clear from your post whether the pay period came and went without compensation or whether this was a matter of not giving a check on the day of departure. Depending on the circumstances, an employee may be able to recover up to three times a wrongfully withheld wage.
