San Diego, CA asked in Divorce for California

Q: My husband wants a divorce, but is working in another country. How can I serve him papers?

The family legal department at the court house said they were unsure if I had to have them professionally served or if I could serve them through a friend who will be traveling there soon. They could not give me a definitive answer. I don't even have the money to pay for the divorce, let alone to have them professionally served.

A: Serving an individual in another country is a complicated issue. Specifically, international treaties may apply, and some countries may object to certain methods of service. Thus, the method of service will depend on the country of service. I understand that finances may be of concern; however, if possible, I recommend that you seek the advice of an attorney to ensure that your items are properly served and that your concerns are addressed. The consequences of inadequate service may have a detrimental impact on your case.
