Q: what are the options when you get denial for F1 visa?
hello. I came to us as a visitor then after a month I applied for F1 visa while I was here. They gave me request for evidence about 2 month ago and I answered them but yesterday(after about 7 month processing my file)they denied my file and they told me we will send the reason for denial in 15 days. now what are my options? what can I do to stay in america and study here?my tourist visa that I came here with that has been revoked about 2 month ago!
A: HIRE AN ATTORNEY! The problem is that you entered on a tourist visa, and then, within one month "decided" to go to school and applied for a change of status to a student. It looks like you intended to go to school all along -that is what the government was thinking when it issued the RFE. You may have an option to file a motion to reopen/reconsider. There is a deadline to submit the same so contact an immigration attorney ASAP.
