Q: My company is a non-subscriber to Texas Workers' Compensation. I want to know their obligations from an unbiased source.
Doing assigned duties, taking out the trash in this case, I was injured at work. There's an open 1.5 ft. drop from sidewalk to parking lot w/o even railing (told NOT against OSHA reg.) Incident report my SM wrote says I took a "shortcut" and "stepped down wrong". Not a shortcut; direct route to the dumpster from store exit. The same one all others use, including SM. Didn't step wrong; couldn't even see over stack they told me to take. Finished my shift, went to the ER. Ankle sprain so bad doctors said it was fractured. Reported to boss same day. Next day had to come in and fill out forms, go to a clinic for a drug test, and for no reason another. Was given 6 wks. of PT by the Dr. I was sent to. All paid for by emp., but still haven't picked up $9k ER bill as they had said. I've been paid for 38 hrs of work per mo. I'm full-time, at 40 hours a wk. After 2.5 mo. was offered trial of duty 2 weeks ago; no word since. No money for a lawyer. Just need to know of 3rd party source for facts.
