Cornelius, NC asked in Criminal Law, Employment Law and Personal Injury for North Carolina

Q: Daughter was attacked and almost raped on the job. What is her employers responsibility in this, the man is still empl

My daughter works at a very exclusive show horse barn and was attacked and would have been raped by another employee at work. They have different bosses. She reported it to her boss and was told as soon as his actual boss is available they will consult him and he has to take the action. Meanwhile she is scared to go to work as long as he is still there - does she have a right to not go until he is gone ?

A: Doesnt sound like the police were called. If someone is attacked then that's a criminal matter. She would certainly have a necessitous and compelling reason not to go to work so should be eligible for unemployment.Contact a member of the NCarolina Trial Lawyrs Assn who handles employment issues--they give free consultations.
