Brattleboro, VT asked in Libel & Slander and Business Law for New York

Q: What kind of protection does a C-corp provide against a legal claim of defamation?

What kind of protection does a C-corp provide against a legal claim of defamation? Right now we're considering publishing an honest and well researched book, but the subject of the book is very aggressive legally and dishonest. If the book is published in a separate C-corp owned by an employee (right now our business is an S-corp which generally works best for my situation) can that provide protection for me personally and for the S-corp and the employee who owns the C-corp; or is one or all of us vulnerable to a legal suit? I wouldn't care of the assets of only the C-corp were vulnerable.

A: The type of entity (c-corp or c-corp) is in all likelihood irrelevant since the utterer / publisher of the alleged defamatory statements can be held individually liable both jointly and severally with the corporate entity.
