Q: Where can I hire a lawyer for a defamation case in NY on a contingency basis?

I am the plaintiff. I have already filed a complaint with the NY Supreme Court, and I, now, must serve the defendants as soon as possible.

That could be a difficult order to fill. Defamation cases are sometimes handled on a contingency basis, but many law firms may instead go with charging hourly. Each case can be different, but generally speaking, slander and libel cases often pose an element of uncertainty in the outcome. This makes... View More

Q: Is leaving a factual review on a job review website considered defamation ?

My colleague left a factual review of the last job we worked at. The boss is threatening legal action for defamation (the review site is anonymous, so she doesn’t know who wrote it) and intimidating the person- to remove the factual review.

It would be best for an attorney who practices in the area of defamation law to advise you, but you await a response for a week. Until then, the short answer is that from a textbook standpoint, factually truthful material would not ordinarily be considered defamation.

However, the practical...

Yes, you can be arrested by local law enforcement even if an altercation happens on Native American owned land. Tribal land has a unique legal status, and the jurisdiction can be complex, involving tribal, federal, and sometimes state laws. However, local law enforcement often has agreements with... View More

My initial answer is that local police do not have the power (lack of jurisdiction) to arrest you for this, but there are complexities in the law. Here is my attempt to explain them.

The ability of local police to arrest someone for an alleged crime like assault that occurred on Native...

Whether the attorney who dismissed the prospects of a disability case or HIPAA case was an employment law or health care law attorney, defamation-based cases can be costly. I had someone file a false police report about me accusing me of domestic violence. When I requested a FOIL of the police reports, it came redacted . It involved going through an appeal process by our town mayor to get an unredacted version
