Los Angeles, CA asked in Bankruptcy, Consumer Law and Collections for California

Q: Is there a way to negotiate car repo fees?

My car was repo'd; I knew I was behind and did contact TFS, to get a payment plan and they said no; they weren't very helpful. The last time I called TFS on August 12, I said that I hadn't been paid yet. I was due to be paid on the 19th & I told them, I was actively looking for another job. I also asked about deferrals, payment plan, voluntary repo, selling, or refinancing; I was told couldn't be done or not recommended. I actually, got paid the day they repo'd it. They are quoting me as owing 1750$ (September 4), but in reality it's 1275$, because it's not September 4th. TFS also said I was driving around without paying since April and they were paid in July. Plus, the repo fees, storage fees, personal property fees, & any other fees.

A: You may be able to reach out to them to negotiate a payment plan. Are they suing you to collect? Or is there a collections agency seeking payment? If there's an agency, you may try to negotiate a payment with them for full settlement of the debt. It's best to have a lawyer handle that so you don't exacerbate the situation.
