Q: Insurance is refusing to cover leak to my service line because it traverses neighboring property. Will an easement help?
I am enrolled in an insurance policy that covers repairs to my service line. I have informed them about my line running through neighbor's property before enrolling. They are now telling me they will not cover because they do not repair lines in other properties. My neighbor has the same insurance coverage so contacted them since they said it's on their property but has said they will not cover because, although it is on their property, it is not their line. I feel taken advantage of this loophole in the insurance policy. Any help?
A: I do not think an easement will help. However, you can sue the insurance company to force them to make repairs. However, you would at all times be liable for your own attorney fees and costs. Whether or not a Court will Order the insurnace company to pay your legal fees is unknown. Good luck.
