Bayside, NY asked in Criminal Law and Domestic Violence for New York

Q: How can I get a temporary order of protection for my daughters modified against me?

It has been more than 4 months since my case started.I have never had a case with ACS.I am being accused of something I didn't do and have evidence and witnesses with hospital records. The person who accused me is the step-mother of my daughters. She abused them and me and is now away, claiming herself victim. She has accepted the final order of protection from my eldest daughter, accepting she did the abuse.I am away from my home right now for 4 months,I have medical conditions and it is not good for my health, I also have hospital and doctor letters supporting that.I don't understand why the court is taking so long for an important decision to be made when I have everything needed to prove the step-mother is guilty of filing a false report and she is the one who abused my kids.It is not good for my health to be away from my home right now,How can I be back with my kids again, because no serious important decision is being made from the court, how do i modify it?

A: The facts you provide are hard to follow. You should talk with a lawyer to clarify such details. If you're trying to fight charges of abuse, submitting evidence properly is key. If you're not doing that well on your own, hire a lawyer. More details are necessary to provide a professional analysis of your issue. The best first step is an Initial Consultation with an Attorney.
