Truxton, NY asked in Employment Law and Workers' Compensation for New York

Q: Do I have a case?

I work at a mass production warehouse that handles stainless steel pipes for mass transit production. Although, i am payed through a temp agency. While at work I had a metal shaving go into my eye and needed medical attention. I notified a supervisor who then took me to the hospital. I got the care I needed and returned to work within three hours. This all happened on 3/2/17. Today 4/21/17 the temp agency called me and notified me that the company I worked for, did not notify them I was injured within 48 hours and I am responsible for my bills because I did not ensure my temp agency was notified. I was at work, wore safety glasses, did my job, please help.

A: Sounds like a great case for a workers compensation lawyer. I have not handled a work comp case in decades but would have loved to represent someone with your facts when I did.

Employers often try to get out of paying by having private insurance pay and the other way as well.

It costs you nothing to hire a comp lawyer. If they don't win they don't get paid. If they win your employer sometimes pays and even if you pay the percentage is closer to 20% than the one third or 40% in personal injury.

If I had a work comp case I myself would hire a work comp lawyer and you should do the same. When I was a young man in college I was involved in a very serious comp accident at a major steel manufacturer. Wish someone had suggested I retain a comp lawyer.
