Buffalo, NY asked in Libel & Slander and Personal Injury for New York

Q: My son is being profiled and slandered by other students and their parents, is there something legally that can be done

My son looks different than the other kids in his school and because he once wore a trench coat to school, the kids started rumours he is a school shooter and now it has gotten out of control with the police being called and parents taking kids out of school because they heard that my son will shoot up the school. My son has never been in a school fight, no violence, nor has ever made such a threat. We do not even own any guns in our house and the police verified this. Is there something we can do?

A: You can complain to the school about the bullying. You can report threats against a minor to the police, and you may be able to sue for defamation and threats of violence. More details are necessary to provide a professional analysis of your issue. The best first step is an Initial Consultation with an Attorney. A: You really need rumor control. Talk to the school to see if they have a collaborative justice project that will bring the idiots into the room with him so they can understand him and hopefully put an end to it.. In Pennsylvania there is or was a group called Fellowship Farm that did get involved in these issues as mediators. Suing for defamation is unlikely to get you anywhere except a deep hole in your pocket. Take your kid on college trips so he gets a sense there's life after high school. Intelligent life, even.
