Q: Contract executed 2 weeks ago, but seller attorney won't provide copy so we can move forward. Anything we can do?
Meaning we are told that they signed, but we have yet to actually see a copy of the contract. No one is responding to our calls. Feeling very stuck. Closing date is in jeopardy at this point, because bank can't do appraisal. Whole process has been a mess. So far NYS real estate laws have been quite a bit different than we're used to, but I can't find any statutes as far as timelines. Are there any? Or can the sellers seriously leave us hanging for as long as they want? Edit: Yes, we have an attorney. They aren't a whole ton of help right now. They've been told by the sellers attorney that contracts were signed, but then nobody seems to be able to send over a copy to our attorney. Meanwhile they cashed our check. We'd like to walk away at this point, but can't afford to lose our money. It's just very frustrating. Thank you all for your help.
A: Unless and until a seller signs and delivers to you a fully signed contract, there isn't much you can do other than walk away from the deal.
A: Seller is probably holding the contract for a better deal. If there is no contract there is no deal. Your broker needs to make it happen or move on.
A: Lean on the broker / seller heavily about this if their lawyer is not responding. Do you have a lawyer? You really should in NYS, it's pretty inexpensive in a normal closing and the guidance is usually very valuable not to mention they act as a buffer in negotiations.
