I cannot imagine a situation where this could happen. I always discuss any offer with a client and recommend that they allow me authority to accept any amount above a certain figure when we are in a position to make a final counter demand.
If a client authorized settlement for, say $50,000 and the lawyer is able to negotiate $75,000, why would the client ever have any problem with that? They could donate the additional money to a church or charity if they didn't want it.
A: The Code of ethics suggests a lawyer may not reject an offer without discussing it with the client. I don't think there's anything in the code that requires a lawyer to consult to get more!
