Q: What is next about my domestic assault case: will face more fail, can my wife ask to drop charges?
Hello,
My wife have severe mental problems. She changes from being very happy to angry in seconds and she gets violent. No matter what I do or say once she sets her mind she get attacks and hits me. So protect my self lately I hold her down until she calms. Once she realizes what is happening she calms down and things work out.
But on Saturday, before she hit me, I hold her thumb and when was pulling it cracked. She tried to attack me again I hold her on the bed and because of the position we are in I ended putting pressure to her throat with my forearm so that she cant get up.
We went to urgent care, they called police, I turned in myself to the adult center that night, paid the bond and got out. Now I have a case in few days.
I have clear record and my wife admits that it was her fault. She is going though therapy and she is getting better, so I dont want this to effect her but at the same I am worried about my own future.
A: You should be worried. A conviction for domestic assault will prevent you from ever possessing or owning a gun. And it does sound like you have a defense. You need to hire an experienced local criminal defense attorney right away to represent you. Your wife simply saying "it was her fault and she wants to drop the charges" is not likely to simply make the charge go away. All the best to you!
