Brooklyn, NY asked in Real Estate Law, Small Claims and Landlord - Tenant for New York

Q: Suing former tenant

I'm suing a small claim against a tenant who made numerous damages and left a lot of their trash but they didn't paid the last month's rent which was order by the judge. We had to use their security deposit which was not enough to cover their rent. During the court day, they made claims that we were harrashing and being racist to them without proof of evidence except for one witness who is connected to the tenant ( dating together that's it but he was not a tenant) and we provided the judge the pictures of the damages and trash they left, the invoice to clean and fix the damages and judgement papers the judge order for her to required to pay rent which she bailed for the last month. The judge reschedule our case for another month because he said it was complicated because of the claim she made about harrashment and racism. What are your thoughts regarding about this as we are only suing her for the purpose of damages and recovering some money from the rent she didn't pay?

A: You will get what is in the invoice and the court order. The rest seems weak, but in small claims anything can happen. It is like Judge Judy.
