Houston, TX asked in Car Accidents, Employment Law and Workers' Compensation for Texas

Q: Had accident in my car while driving for work. Settled claim w personal coverage. Just found out cmpny is responsible

The accident occurred 2.5 years ago. Minor rear-end. It was my fault. No injured parties. My insurance company paid for a total loss because the cost to replace the air bag and steering wheel/shaft was greater than 75% value of the car. Didn't know that I could've filed the claim under the company's policy since I was using my personal vehicle for work purposes. Do I have any options to get the company to pay under their policy? Left the company a year ago.

A: Assuming your company knew about this, they wouldn't have paid if someone else was primary--and if they did they would have made a claim against them.

By the way, if they didn't know you used your car for work you may want to let it be--otherwise they can cancel you as most policies don't cover vehicles used at work.
