Mill Valley, CA asked in Divorce for California

Q: My husband makes $300K and I made $50K until I just got a raise to $70K - will alimony start date of separation? or now

We are trying to work out our finances on our own but I am trying to figure out if it is worth it to hire an attorney. We are both agreeing to stick with whatever the law says. We have been married for 25 years, and we have always both worked. I'm not sure if I would get alimony, is there a basic formula?

A: It sounds like you would indeed be entitled to spousal support. When it starts can be agreed upon between the two of you. If someone were to file a motion with the court for an order for spousal support, the support order would be retroactive to the date the motion was filed.

A: You are entitled to 1/2 of of everything including and probably 1/2 of his salary for life and 1/2 of all savings and investments, 401K’s and half of all real estate holdings. Looks like you should be getting about $15,000 per month until he retires. You probably will get a large portion of his Retirement and SS. If he owns a business, you are entitled to 1/2 of everything.... bottom line, you should consult with a Family Law attorney to get advise. Good luck!
