Q: I am in the middle of a divorce and my ex will not agree to 50/50 custody. Will a judge give father 50%?
I travel for work but I can limit my schedule to certain days. She is saying since I won't agree to her schedule she won't let me see the kids. Will a judge rule towards a mother having primary custody vs 50% when a father wants it and there is no reason she can support as to why I shouldn't?
A: Most Judges will be quite displeased with a mother who attempts to dictate the schedule by withholding visitation. I have literally seen children go into to Court with the mother and come out of Court with the father. So you need to be able to prove she is doing what you are saying. There is no question the best thing to do is for you and the mother to work together cooperatively. But if she is refusing to be reasonable you may have to enlist the Court to modify her attitude.
