New York, NY asked in Civil Litigation, Contracts, Real Estate Law and Landlord - Tenant for New York

Q: How do I evict a roommate, who is not on the lease and just went "incommunicado" after a week?

I told him from the very explicit, starting public post on craigslist we would both sign an agreement. I never cashed his money order waiting for him to do so, but he hasn't come back, nor has he called me back or replied to my various email messages. I want to give him back his money in full ($750) upon return of the set of keys I gave him and return his stuff (not much, I think he just slept in the place twice). I know his phone number, email and where he works, because he told me. I am not even sure if he found another place and doesn't even care about getting back to me, went back to his parents or probably something may have happened to him or if he is somehow playing games with me. How do you go about dealing with such a situation legally? What do the current housing laws prescribe about such a situation? What would you do?
