San Diego, CA asked in Divorce, Child Custody, Child Support and Identity Theft for California

Q: Im returning to court to finalize a 10 yr old divorce with my old Lawyer but he won't even talk to me, what can I do?

My ex signed to an agreement in FCS Appt in 2008 but when we appeared he suddenly flipped out and stormed out. A judgement was sent by my attorney but there was no response. @ $100 a try, I stopped after 3. My ex didn't comply with anything in the agreement and soon ended up in prison.10 yrs later he suddenly wants it done. All the debt he left me with is almost gone and Im broke, bad credit and he's fine. Paying 23% Child support [Time share in 90%/10% I am CP] after not paying anything for years. I DON'T THINK Divorce should be considered and new agreement shld be negotiated. I was abused and didn't know he'd stolen my ID and used my SS then. Attorney won't return calls. Just sent copy of notice to appear that doesn't even show me needing to appear via his website. Legally do I have a valid reason to have old agreement tossed and possible renegotiate better terms?

A: You reference an old "agreement", but if your ex never signed it, it's not an agreement. If you are not getting cooperation from your attorney, let him go and hire a new one. Sounds like you have a lot of issues that could be addressed in your case, including getting more child support.
