Q: if a attorney advises there client to hire a fiduciary and the cient suspects a conflict how to prove it

I hired a attorney who advised us to hire a fiduciary to help us in our estate the fiduciary's attorney was a former employee of our former attorneys who quit just weeks before trial. our attorneys never told us about the fiduciary's attorney working for them and when they quit the fiduciary and his attorney failed to act in our best interest and have retaliated against us evicting us from our home and not paying taxes and listing our mortgage free home against our wishes and have caused my family much loss and financhacial hardship . what can be done to stop the sale of our home before it closed escrow. and bring suit against the fiduciary and his attorney for damages. they said the estate had no money to pay the taxes but they were able to paint and install new carpet and appliences to get more for our home that we were evicted from we need immediate help to stop the fiduciary .

A: You need to contact a local lawyer for wherever you live.

Sometimes an "appearance" of a conflict is not really a conflict and other times an appearance alone is enough to warrant a different lawyer.

Have you had a consultation with a lawyer who agrees there is a conflict? If so contact the State Bar of California for assistance.
