Q: I am looking to break my lease, but in my contract, there is no cancellation section. What are my options?

My contract does not state anything on it saying what the fee would be for breaking the lease. My landlord is telling me that I would have to pay the remainder of the lease if I do break it.

A: Generally there is no "right" to break a lease and the tenant does usually have to pay the remaining rent under the lease through the end of the term. However, a landlord has a duty to mitigate damages in Maryland, which means the Landlord must try to re-rent the place and credit a departing tenant with whatever rent they receive from a new tenant.

There are some limited exceptions to this general rule if say the tenant is in the military and called to active duty somewhere else.
