Q: Can my spouse do anything about me getting pregnant during separation?
My spouse and I have been separated since March of 2017. No legal separation as we could not afford it, just been living under different roofs since then. It's right at the time for us to file for our divorce. We have both been seeing other people since we split. He gets mad and sends me pictures and texts talking about him and all these other girls he's been seeing, then denies it later. I don't care either way. He can do what he wants in my opinion. I've been with the same man whom he knows nothing about because he's a little bit "crazy" for the lack of a better word. I just found out almost a week ago I am pregnant with this mans child. Can my soon to be ex-husband do anything to either of us?
A: There is no such thing as a 'legal separation' nor do you have to pay for it. All that is required is that you live in separate residences and at least one of you has the intent not to resume the marital relationship - meet those two simple requirements and you are as separated as you ever will be. As to your situation, you have likely committed the crime of adultery - although it is likely no DA would ever be interested in prosecuting you for it (the jails would be over flowing). Your husband could potentially sue your boyfriend (if you boyfriend has assets worth going after) but he would likely lose based on your description of things. So from a legal standpoint, realistically there is not much of a downside for you except the fact that you boyfriend will likely not be able to be listed on the birth certificate. You should likely be more concerned about what your husband may do from an illegal standpoint.
