Q: Is it possible to fight and beat this case?
Hello I am 16 and on the first monday of spring break me and a friend were pulled over and cuffed for call they received for burglary of a vehicle. However they did not charge us with it we were let off with curfew tickets. Well the officers had told my mom that i didn't admit to anything but since my friend did they are going to use that against me. They did find what was stolen in the my friends truck. Now on March, 29 2 detectives had came to my school and arrested me and took me into LCJJC (Lubbock) and they charged me with burglary of a vehicle. Is it possible to fight this case? And what should I do next both times I was cuffed I was not read miranda rights I do not know if that matters but they didn't.
A: You have the right to enter a plea of not guilty and force the State to prove any allegation against you beyond a reasonable doubt. No one in this forum, however, can accurately evaluate your probability of success, since we don't know the evidence the State has in its possession. Start calling local attorneys. Good luck.
A: The Miranda warnings impact whether or not they can use the statements you made while in custody. If you didn't admit to anything then there is nothing for them to use, with or without the Miranda rights warnings. Consult with your criminal defense attorney about this matter in private and don't post details of the accusation on a public internet website!
