Hi. I'm in need of legal advice. I moved into my Beacon address 4/1/18 with a 12 month lease. Please read below:
There are 3 units to this attached house: 1 occupied by landlady's 77 year -old father and step-mother.. Landlady was unreachable October 13 - 16 when father kept calling to say we had no heat And from what he could tell, boiler was broken. He had no authority to take action on his own.
Late on Tuesday, 10/16, we got heat for the first time. I registered complaints with the city of Beacon 10/15. I'm aware of a senior living facility in the area that will accept my application and wish to move there as I do not trust this landlady to keep providing heat or anything else for which she is responsible. She has a 1 month deposit, $500 deposit for my dog, and final month's rent. What notice must I give in order to not lose it all? Thank you so much.
A: If you have a lease, you are responsible for the unexpired term of the lease whether you live in the premises or not. If you want to avoid that situation, you can attempt to negotiate with your landlord, or have an attorney do so on your behalf. Although the landlord may not be obligated to release you from the terms of the lease, some landlord's will accept a cancellation fee and agree to allow you to do so.
