Q: Can I change lawyers if I chose to? I am in a middle of a divorce proceeding and my current lawyer is delaying my case.

A: You can always choose who your lawyer is, so if you aren’t satisfied, changing attorneys is one option.

May I suggest, before you do that, to talk to your attorney. Share your concern that the case is being delayed and ask how s/he can move the case along. While it is possible the delay is your attorney, it may very well be something else.

When you hire a new attorney, a certain portion of the money you spend with that attorney is him/her getting up to speed on your case, something your current attorney already has done.

A: You are allowed to change lawyers at any time, regardless of the reason and regardless of whether the existing lawyer consents.

Once you have selected a new lawyer, he or she will prepare a "Substitution of Attorney" form and send it to the existing lawyer and the Court. This will let everyone know that you have a new lawyer.

You are also entitled to your file from the existing lawyer.
